Official Rules
 
NO PURCHASE IS NECESSARY TO ENTER OR WIN.

 

Cox Education Heroes Program (the “Program”) starts on March 1, 2024, at 8:00 a.m. Central Standard Time (“CST”) and ends on June 1, 2024, at 11:59 p.m. CST (“Program Period”). The Program provides eligible individuals (the “Nominators”) with the opportunity to nominate a local educator who otherwise meets the eligibility criteria as detailed herein (a “Nomination” and each nominated educator, a “Nominee”) to be named a Cox Education Hero.  Nominations will be reviewed by representatives of Sponsor to select the winners, as more fully set forth below. Nominations can be submitted from March 1, 2024, at 8:00 a.m. CST to March 31, 2024, at 11:59 p.m. CST (the “Nomination Period”).

 

ELIGIBILITY: Nominators must be legal United States residents who are eighteen (18) years of age or older and reside in Cox’s greater Omaha, Nebraska service area. Program “Judges” (as defined below) may not be Nominators.  Void outside of the Cox Omaha, Nebraska service area and where prohibited by law. Program is subject to all applicable federal, state and local laws.

 

Nominees must be an employee at a private or public primary or secondary school in Cox’s greater Omaha, Nebraska service area, which includes the following cities: Omaha, Bellevue, Ralston, LaVista, Papillion, Bennington, Westside, Gretna, Elkhorn, Millard, Valley, Fremont and Blair, Nebraska; and Council Bluffs, Crescent, Carter Lake and Pottawattamie County, Iowa. Superintendents, principles, IT Department Leaders or any other employee who is responsible for making procurement decisions are not eligible and cannot be nominated. Additionally, employees of Cox Communications Inc. (“Sponsor”), and its parent, subsidiaries, affiliates, promotion and advertising agencies, and immediate family members of individuals sitting on the winner selection committee along with those living in the same household of each are not eligible to be a Nominee.

 

HOW TO SUBMIT A NOMINATION:

Nominators may go to www.CoxEducationHeroes.com (the “Website”) and complete the Nomination form with the information requested.  As part of the Nomination form, Nominators must include a no more than five hundred (500) word essay describing why the Nominee should be named a Cox Education Hero, what the Nominee has done to go above and beyond supporting students throughout their career, and the number of students impacted by the Nominee(the “Essay”).  All completed Nominations must be submitted by the end of the Nomination Period. 

REQUIREMENTS OF ESSAYS:

Essays must (i) be Nominee’s own original work, (ii) be in English, (iii) cannot be previously published or submitted in connection with any other promotion or program, (iv) be in keeping with the Sponsor’s image and (v) not be offensive or inappropriate, as determined by the Sponsor in its sole discretion, nor can it defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights.  Sponsor reserves the right to disqualify any Nomination that it determines, in its sole discretion, is offensive or inappropriate, not in keeping with Sponsor’s image or that is otherwise not in compliance with these Official Rules.

 

Limit one (1) Nomination per Nominator per Nominee. Nominations received from any person or email address in excess of the limitation will be void. All Nominations become the sole property of the Sponsor and will not be returned. 

 

All requested information on the Nomination form must be completed. Any communication or information transmitted to Sponsor is and will be treated as non-confidential and nonproprietary. Proof of submission is not considered proof of delivery to or receipt of such nomination. Furthermore, Sponsor shall have no liability for any Nomination that is lost, intercepted or not received by the Sponsor.

 

IMPORTANT NOTE: In the event that there are an insufficient number of eligible Nominations, Sponsor reserves the right to extend the Nomination Deadline and/or select fewer winners than indicated herein.

 

By submitting a Nomination, Nominator acknowledges and agrees that Sponsor may obtain many Nominations in connection with this Program and/or other promotions or programs  staged and/or promoted by the Sponsor, and that such Nominations may be similar or identical in theme, idea, format or other respects to other Nominations submitted in connection with this Program and/or other promotions sponsored by the Sponsor or submitted for other reasons or other materials developed by the Sponsor. Nominator waives any and all claims they may have had, may have, and/or may have in the future, that any Nomination and/or other works accepted, reviewed and/or used by the Nominator may be similar to their Nomination, or that any compensation is due to Nominator in connection with such Nomination or other works used by Sponsor.

 

JUDGING: All eligible Nominations received by Sponsor will be judged by a panel of qualified judges (the “Judges”) based on the following criteria (collectively, the “Judging Criteria”): what the Nominee has done to go above and beyond supporting students throughout their career – 65%; the number of students impacted by the Nominee – 30%, and what community the Nominee impacts – 5%.

 

The twenty (20) Nominations with the highest scores will each be deemed a potential winner. In the event of a tie, an additional, “tie-breaking” judge will determine the winner(s) based on the criteria listed herein. Sponsor reserves the right not to award all prizes if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Nominations. Prize awards are subject to verification of eligibility and compliance with these Official Rules.

 

WINNER NOTIFICATION: Judges’ and Sponsor’s decisions are final and binding on all matters relating to this Program. The Nominators and the Nominees will be contacted to confirm eligibility once selected and to obtain each potential winning Nominee’s agreement with these Official Rules. Potential winners will be notified by telephone and/or email. Any potential winning Nominee may be required to sign and return an Affidavit of Eligibility, a Liability Release, and (where imposing such condition is legal) a Publicity Release (collectively, “Prize Claim Documents”).  If Nominee fails or refuses to sign and return all Prize Claim Documents within five (5) days of prize notification (or a shorter time if required by exigencies), winner may be disqualified and an alternate winner may be selected. Additionally, Sponsor may require the potential winner to provide Sponsor with proof of employment in order to prove eligibility. Return of prize or prize notification as undeliverable, failure to sign and return requested documentation within the specified time period, the inability of Sponsor to contact a potential winner within a reasonable time period or noncompliance with these Official Rules by any potential winner will result in disqualification and, at Sponsor’s sole discretion, the prize may be awarded to a runner-up. If any potential winner is an eligible minor in their jurisdiction of residence, Sponsor reserves the right to award the prize in the name of their parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein.

 

GRANT OF RIGHTS: Each Nominator hereby irrevocably grants to Sponsor, its designees, affiliates, successors and assigns, the exclusive, irrevocable, fully paid, universal license to use, copy, sublicense, transmit, distribute, publish, delete or display their Essay in any media now known or hereafter devised including, but not limited to all forms of electronic media, print media and all forms of internet and wireless protocol in perpetuity and throughout the universe for advertising, marketing, publicity and promotional purposes in connection with the Program and other promotions. Sponsor shall have the right, in its sole discretion, to edit, composite, morph, scan, duplicate, or alter the Essays for any purpose which Sponsor deems necessary or desirable, and each entrant irrevocably waives any and all so-called moral rights they may have therein.

 

PRIZES: Twenty Nominee Prizes are available. Each Nominee Prize consists of one (1) $500 gift card to Nebraska Furniture Mart, and one (1) Cox Education Heroes t-shirt. The Approximate Retail Value (“ARV”) of each Nominee Prize is $525.

Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winners may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. Winners are responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided.  All prize details are at Sponsor’s sole discretion. Gift card is subject to certain terms and conditions as specified by issuer.

GENERAL CONDITIONS:  By participating, each Nominator and Nominee (or if minors, their parents or legal guardians) agrees: (a) to abide by these Official Rules and decisions of Sponsor and judges, which shall be final and binding in all respects relating to this Program; (b) to release, discharge and hold harmless Sponsor, and its respective parent, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Program or any Program-related activity or the acceptance, possession, use or misuse of any awarded prize; and (c) to the use of their name, voice, performance, photograph/video, image and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from  entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so.  By participating, entrant also agrees not to release any publicity or other materials on their own or through someone else regarding their participation in the Program without the prior consent of the Sponsor, which it may withhold in its sole discretion. 

MISCELLANEOUS: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Program, including, without limitation, errors or difficulties which may occur in connection with the administration of the Program, the processing or judging of entries, the announcement of the prizes, the incorrect uploading of the essay or in any Program-related materials.  Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Program.  Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Program or downloading materials from or use of the website.  Persons who tamper with or abuse any aspect of the Program or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Program be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Program and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to action taken using the judging procedure outlined above. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

ARBITRATION: Except where prohibited by law, as a condition of participating in this Program, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Program, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.

CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Nebraska, USA.
